I undertake medical negligence work in the field of spinal surgery
Appointments
We endeavour
to give an appointment date within 7 working days of the letter of instruction.
The timescale for seeing the client and medical assessment is in the
region of some 2-4 weeks.
Medical Report:
Our intention
is to issue the Medical Report within 2-3 weeks following the assessment
pending availability of the medical records and radiographs. In urgent
circumstances the report can be issued earlier with the proviso that
a supplementary letter will follow on perusal of the relevant records.
Woolf
Report
I am familiar
with the requirements of the Woolf Report, that my duty is to the Court
and that on occasions I am required to liaise with other medical specialists
and generate combined statements to fulfil my obligations.
Court
Appearance
I have
regularly appeared in Court to give evidence. The frequency of this
is approximately 5-10 times per year although often warned in excess
on some 25-30 occasions.
Lectures
I have
previously lectured to distinguished solicitors’ bodies on mild to moderate
injuries with respect to personal injury and regularly receive repeat
invitations for further presentations.
Fees
Fees are
negotiable, in general terms, dependent on geographical venue of the
consultation and Medical Report, the difficulty in procuring various
records and complexity of cases. Scale varies from £300 per report.
For regular instructions and block bookings, I am willing to negotiate
a separate fee scale.
Fees
for Court Appearances
The fee
is £1,200 per day or part of day depending on the geographical location
of the hearing. The figure would also include travel expenses and accommodation
where appropriate.
For cancellation
of a court hearing I use a sliding scale. If the case is settled within
48 hours of the hearing – full costs, if the case is settled between
48 hours and 5 working days – 5% of the arranged fee is chargeable.
Difficulties arise with restructuring of work programmes so close to
cancellation dates and invariably involves loss of revenue.
